Protect your rights and your assets. Avoid excessive taxes, don't let them diminish your estate.
Estate planning is the process of involving professional advisors who are familiar with your goals and concerns, your assets and how they are owned, and your family structure in order to determine the best disposition of your property at death as well as a variety of other personal matters.
Will: You determine who receives your property and who is guardian of your minor children.
Trust: Provide for yourself and/or your heirs; controlling the use of your funds after your death.
Health Care Directive: You choose who makes medical decisions regarding your life if you are unable to do so for yourself.
Durable Powers of Attorney: Safeguard your own affairs; this will keep your business out of the Court system.
Homebound or hospital consultations are available if required.
Focusing on the legal needs of the elderly we counsel clients and their families regarding the following matters:
- Health and long-term care planning
- Public benefits (includes Medicaid, Medicare, Social Security)
- Surrogate decision-making (includes powers of attorney and guardianship)
- The older persons' legal capacity
- The conservation, disposition and administration of the older person's estate (includes wills, trust and probate of an estate)
For the protection of the disabled, elderly or minors.
The purpose of a guardianship or conservatorship is to ensure that continuing care is provided for persons who are unable to take care of themselves or their property.
A guardian is an individual, organization or agency appointed by the Court to make decisions on behalf of a person who lacks sufficient understanding or capacity to make or communicate responsible decisions concerning his or her person
A conservator is an individual, corporation or agency appointed by the Court to protect and manage the money and property of a person that the court has determined is unable to do so for himself or herself
Probate is a court proceeding that transfers legal title of property from the estate of the person who has died to his or her proper beneficiaries. It is the process by which assets are gathered, applied to pay debts, taxes and expenses of administration, and distributed to those designated as beneficiaries in the will.
We will guide you or your loved ones through the entire process minimizing the stress during this difficult period of time.
